U.S. District Court Suggests Commerce Clause May Bar RCRA Citizen Suit Where Contamination is Localized
In Voggenthaler v. Maryland Square, LLC, District Judge states where "the contamination is a local and isolated plume that does not affect [interstate commerce]" the court lacks subject matter jurisdiction over the RCRA claims.
